Financial Coaching Service Agreement
The following represents the Agreement between Kimberly Glasper (“Financial Coach” or “Coach”), who is the representative of Level Up Coaching LLC, and the “Client”. The Services contracted shall be that of life coaching. Please read it carefully and raise any questions or concerns before agreeing to the contract. This agreement will begin upon acceptance by the Client and shall remain valid for the duration of the Client-Coach relationship as stated by the package chosen by the Client.
Professional Advice
Coach will provide financial guidance during the term of the agreement. No specific outcome is guaranteed, and it is up to the Client to manage the direction of the guidance. While investments may be discussed during the coaching sessions, it is not the intention of this agreement to provide investment advice. The client is advised to consider a Personal Financial Planner or Personal Financial Advisor for such advice. The purpose of financial coaching is to evaluate your current financial situation and educate you on how to meet your financial goals, including recommendations for specific courses of action. The Financial Coach will not give tax or legal advice. However, may refer the client to professionals in those areas.
Services
The services to be provided by the Coach to the Client are financial coaching (as described below), including one-on-one coaching, as well as e-mail and text support and research services provided by the Coach, as designed jointly with the Client. The Client understand that the power of the coaching relationship can only be granted by the Client. Financial Coaching is not investment advice or financial planning. Rather, coaching seeks to empower the Client through education and skill building so that the Client is better able to make his/her own financial choices. Coaching services based on Client package option could include goal clarification, brainstorming, teaching client how to find, understand, and use income, stewardship, creating and utilizing a budget, how to save and pay off debt. The Client has the right to decline any/all coaching requests. The Coach uniformly agrees to respect and maintain the highest level of confidentiality. During the course of the Financial Coaching program, the Coach may share with the Client information and/or independent research or opinions on stocks, trading or other services using outside sources believed, but not guaranteed, to be accurate. In no case should this data be construed as a solicitation to buy or sell a particular issue or product. Financial coaching is not a replacement for financial advisory and planning services; rather, it enables the Client to work with financial advisors, planners, and brokers more effectively. The Coach works strictly on a fee for service basis and does not accept commission or other remuneration from any brokerage or financial services firm. The Client expressly agrees that he/she is participating in coaching as a purely voluntary activity, and that he/she assumes all investment and financial risks potential in this activity.
Terms of Coaching
Receiving financial coaching is a process. Many people create change for themselves in a short time. However, to refine and sustain the change takes several months. Although not binding, it is recommended and expected to maintain the service for at least 3 months.
Coaching Fees
Fees are outlined with each package and are paid in advance of booking sessions. Payments are made online through automation. In the event Client fails to pay any amount due by 24 hours prior to the scheduled session, it may be cancelled at the Coach’s discretion.
Coaching sessions are typically one hour in length. The introductory meeting may be provided at no charge. This gives the Coach and Client a chance to get to know one another and decide if a comfort level can be established. After the introductory meeting, services provided by the Coach will be performed at the rate specified in the package of the Client’s choosing. Sessions will be conducted by phone and check- ins will be conducted by phone, email, or text, whatever is specified in the Client’s package. After the coaching has been completed, we will evaluate together. Additional sessions for monitoring are typically suggested for up to one year or more, on a case-by-case basis.
Payment Method
Payments are made online through automation and are due prior to booking. In the event Client fails to pay any amount due by 24 hours prior to the scheduled session, it may be cancelled at the Coach’s discretion.
Confidentiality
Except as otherwise agreed or required by law, Coach will keep confidential all information concerning Clients’ identity, financial affairs, or investments. When signing a written agreement with the Financial Coach, the Client is authorizing the Coach to provide Client with guidance and advice the Coach feels is in the Client’s best interest; understanding that the Financial Coach is not a Financial Advisor.
As it is known some means of communication, such as wireless telephones and e‐ mail may be not secure from eavesdropping. It is impossible to guarantee the protection of confidential information in certain circumstances involving computers. This is particularly true of email and information stored on computers that are connected to the internet. The Coach will take measures to prevent unauthorized access to information by utilizing encryption and other forms of security protection. The Client acknowledges that the Coach cannot be held responsible for instances of loss of confidentiality through wireless telephone or computer hacking.
Non-Disclosure Agreement
The Client WILL NOT share any of this agreement content, course/session content, course/session contacts, that is provided by the Financial Coach, at any time either written, verbally, electronically, or physically with anyone. The Client understands the information that is shared is CONFINDENTIAL and WILL NOT share in anyway with anyone. The Client understands that the information shared in these sessions is meant to assist with his/her budgeting and financial management needs but is NOT A GUARANTEE of success. Success of this program will be solely based on Client’s ability to use the tips and strategies that are taught within the sessions. The Client understands that this course is not designed to serve as a replacement for licensed professional financial advisement or counseling.
Termination of Agreement
This agreement will remain in effect for the term listed in the Client’s package or until terminated by either party. If either party wishes to end this Coaching Agreement, he or she will notify the other party either by phone or email.
Cancellations/Refund
The Client must give 24hrs notice if he/she needs to cancel or change the time of an appointment. Cancellation (less than 24hrs before) and/or no‐show appointments will be recorded as completed sessions and are not refundable.
The Client may cancel an order within 24 hours of purchasing and request a refund. A refund will be issued, minus a 5% transaction fee. To cancel an order, send your request ladykimcoaches@gmail.com. The refund will be issued through the method in which it was received.
If the Client cancels after beginning sessions and/or receiving services with Level Up Coaching, they may only request a refund for a prorated amount pertaining to remaining sessions or hours not yet logged. The Client will not have the right to cancel or request a refund after the services have been fully performed and/or after all sessions or services have been completed.
A 5% transaction fee of the refund amount will apply and be subtracted from all refunds.
Client Responsibility
The Client assumes total responsibility for the financial decisions made and will not hold the Coach responsible for any consequences resulting from his/her choices or actions. The Client understands that he/she will only receive the services which are outlined in the package they chose. The Client understands that the Coach will not make decisions or contact creditors or others on his/her behalf. Making decisions and taking action is the Client’s responsibility. The Client understands that the Coach will be there to support and encourage him/her during the term of the agreement. Ultimately, the Client is responsible for his/her actions and hold blameless any adverse or other consequences, including but not limited to financial, personal, employment, relational, or other losses, arising out of decision or actions that the Client may take as a result of the services provided by the Coach.
